They show how revenues, profits, and other financial information of corporate groups are distributed across different countries. In Romania, the law sets clear rules for each type of reporting. This article explains the differences between CbCr and Public CbCr, as well as the specific requirements for each.<\/p>\n<p><strong>Differences Between CbCr and Public CbCr<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\"><strong>CbCr Reporting<\/strong><\/span><\/p>\n<p><strong>Who Reports:<\/strong><\/p>\n<p style=\"padding-left: 40px;\">\u2022 The report is prepared by the parent company or another designated entity within the multinational group.<\/p>\n<p><strong>Forms:<\/strong><\/p>\n<p>In Romania, there are two reporting forms:<\/p>\n<p style=\"padding-left: 40px;\"><strong>\u2022 R404 (The Report):<\/strong> The main report submitted by the parent company or the designated entity.<\/p>\n<p style=\"padding-left: 40px;\"><strong>\u2022 R405 (The Notification):<\/strong> A notification submitted by subsidiaries to inform ANAF which entity will prepare the report.<\/p>\n<p><strong>Deadlines:<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>\u2022 R404:<\/strong> Must be submitted within 12 months of the end of the group\u2019s fiscal year.<\/p>\n<p style=\"padding-left: 40px;\"><strong>\u2022 R405:<\/strong> Must be submitted by the end of the group\u2019s fiscal year, but no later than the deadline for the annual tax return (Form 101).<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Public CbCr Reporting<\/strong><\/span><\/p>\n<p>Until the provisions of Regulation (EU) 2024\/2952 are applied for the financial year beginning on or after January 1, 2025, companies subject to public CbC reporting requirements may opt for one of the following reporting methods:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li>Using the guidelines in European legislation on standard CbCr reporting.<\/li>\n<li>Using the report template provided by Regulation (EU) 2024\/2952.<\/li>\n<li>Creating a custom format that meets accounting requirements.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p><strong>Deadlines:<\/strong><\/p>\n<p style=\"padding-left: 40px;\">\u2022 The report must be published on the company\u2019s website within 12 months of the end of the fiscal year.<\/p>\n<p style=\"padding-left: 40px;\">\u2022 It must remain accessible to the public free of charge for at least five years.<\/p>\n<p style=\"padding-left: 40px;\">\u2022 If the report is published on the Trade Registry\u2019s website, the company\u2019s website must include a link to it.<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>CbCr and Public CbCr have similar purposes\u2014to enhance fiscal transparency\u2014but differ in their users and publication methods.
