There are many myths surrounding this topic that create confusion and can expose businesses to fiscal risks and significant penalties.<\/p>\n<p data-start=\"86\" data-end=\"466\">Below, we have selected some of the most widespread myths and explained them simply, with practical examples.<\/p>\n<p data-start=\"468\" data-end=\"813\"><strong data-start=\"470\" data-end=\"550\">Myth 1: \u201cOnly large multinationals have to prepare a transfer pricing file.\u201d<\/strong><\/p>\n<p data-start=\"468\" data-end=\"813\"><strong data-start=\"553\" data-end=\"565\">Reality:<\/strong> The obligation arises depending on the value of transactions with affiliates and the taxpayer category (large, medium, small). Even smaller Romanian companies may be required to prepare the documentation if they exceed the thresholds set by law.<\/p>\n<p data-start=\"815\" data-end=\"1045\"><strong data-start=\"817\" data-end=\"908\">Myth 2: \u201cIf I only have transactions in Romania, I don\u2019t need a transfer pricing file.\u201d<\/strong><\/p>\n<p data-start=\"815\" data-end=\"1045\"><strong data-start=\"911\" data-end=\"923\">Reality:<\/strong> The regulations apply to any transactions with affiliated persons, even if all the companies involved are from Romania.<\/p>\n<p data-start=\"1047\" data-end=\"1563\"><strong data-start=\"1049\" data-end=\"1060\">Myth 3:<\/strong> Adjustments between Romanian affiliated entities are mirrored, so I have no risk. Nothing could be further from the truth. If the transactions are large and the affiliated entities recording the expense are at a loss, while those recording the revenue are profitable and are adjusted by the tax inspection teams, the latter will face a positive fiscal adjustment, while the loss-making entities will increase their loss. In some cases, the additional amounts to be paid have reached tens of millions.<\/p>\n<p data-start=\"1565\" data-end=\"1898\"><strong data-start=\"1567\" data-end=\"1656\">Myth 4: \u201cIf I have contracts between affiliates, I no longer need to justify prices.\u201d<\/strong><\/p>\n<p data-start=\"1565\" data-end=\"1898\"><strong data-start=\"1659\" data-end=\"1671\">Reality:<\/strong> The authorities require proof that the prices are at arm\u2019s length, meaning similar to those applied between independent companies. A contract helps, but without comparability studies and financial analyses, it is not enough.<\/p>\n<p data-start=\"1900\" data-end=\"2249\"><strong data-start=\"1902\" data-end=\"1962\">Myth 5: \u201cTransfer pricing is just an accounting matter.\u201d<\/strong><\/p>\n<p data-start=\"1900\" data-end=\"2249\"><strong data-start=\"1965\" data-end=\"1977\">Reality:<\/strong> Transfer pricing involves fiscal and legal strategy. It includes economic analyses, benchmarks, internal policies, and complex documentation. It is not just an \u201caccounting paper.\u201d Accountants cannot prepare such analyses and usually need the support of tax consultants.<\/p>\n<p data-start=\"2251\" data-end=\"2482\"><strong data-start=\"2253\" data-end=\"2333\">Myth 6: \u201cIf I have losses, I don\u2019t have to prepare a transfer pricing file.\u201d<\/strong><\/p>\n<p data-start=\"2251\" data-end=\"2482\"><strong data-start=\"2336\" data-end=\"2348\">Reality:<\/strong> ANAF particularly inspects companies with losses, precisely to analyze whether the losses result from transactions with affiliates.<\/p>\n<p data-start=\"2484\" data-end=\"2754\"><strong data-start=\"2486\" data-end=\"2559\">Myth 7: \u201cThe transfer pricing file is prepared only during an audit.\u201d<\/strong><\/p>\n<p data-start=\"2484\" data-end=\"2754\"><strong data-start=\"2562\" data-end=\"2574\">Reality:<\/strong> Legislation sets clear deadlines for submitting the file, and its absence can lead to significant fines. Moreover, preparing it in advance helps avoid costly fiscal adjustments.<\/p>\n<p data-start=\"2756\" data-end=\"3020\"><strong data-start=\"2758\" data-end=\"2825\">Myth 8: \u201cIf I have many small transactions, it doesn\u2019t matter.\u201d<\/strong><\/p>\n<p data-start=\"2756\" data-end=\"3020\"><strong data-start=\"2828\" data-end=\"2840\">Reality:<\/strong> ANAF can aggregate transactions of the same type. Multiple small contracts with the same affiliated company can exceed the threshold and require the company to prepare the file.<\/p>\n<p data-start=\"3022\" data-end=\"3233\">Transfer pricing should not be seen as a bureaucratic formality but as a mechanism for fiscal compliance and transparency.
